Tanduo incident- the trial continues

KOTA KINABALU:- The high court was told today that a federal police officer took the initiative to prepare his unit on the day he heard an intrusion by Sulu gunmen was underway at Kampung Tanduo, Lahad Datu, about two years ago.

Despite not receiving any instruction from his superiors, ASP Muhammad Fauzairi Jaidi, who was the supervising officer of the Bukit Aman Special Branch (SB) communication interception unit, explained that he resorted to such action as the incident involved national security.

He felt that early preparation was crucial, in case there were requests for his unit to intercept calls.

About 3.30pm on Feb 12, 2013, he said he was at home when informed by internal sources that an intrusion by the so-called Sulu sultanate had occurred at Kampung Tanduo, Lahad Datu.

“I made myself present in the office to make preparations on communication interception tasks such as planning a duty roster, organising the strengths of personnel on duty and other preparations which I thought were necessary,” he said, adding that there were three officers under his charge.

Testifying in the trial of 30 individuals linked to the intrusion, Muhammad Fauzairi said at 5.35pm that day, he received a call from SB officer Supt Anuar Ahmad instructing him to make preparations to intercept calls of a target by the name of ‘Al-Wajir Osman alias Abdul’.

About half an hour later, Anuar contacted him again to commence with the communication interception on the target who was using mobile number 012-8284091.

To a question by Deputy Public Prosecutor Datuk Abdul Wahab Mohamed, the witness said Anuar also supplied him with security information on the target which included details of the target’s possible involvement in the intrusion and his contacts.

On the morning of Feb 14, 2013, Muhammad Fauzairi said Anuar had called him at his office to intercept calls of another target known as ‘Datu Agbimuddin’ who was using mobile numbers 014-2847213 and 017-8900767.

He also said on that day, SB operations coordinating officer ASP Mohamad Hasnal Jamil contacted him, requesting information on the communication interception on Datu Agbimuddin and the witness provided him with the outcome of the interception on one of the two numbers used by the target, which was 014-2847213.

Abdul Wahab: What was the purpose of the (communication interception) outcome
of this number as requested by ASP Hasnal?

Muhammad Fauzairi: To make initial investigation on the suspect’s involvement
in the intrusion incident.

Abdul Wahab: What did you do next?

Muhammad Fauzairi: I supplied information on the communication interception from the date the interception commenced. It (information) was also meant for ASP Hasnal to carry out technical analysis on the target, Datu Agbimuddin who was using the telephone number 014-2847213.

The witness said information on the communication interception on Datu Agbimuddin was passed on to Mohamad Hasnal by hand and further information on the target was relayed to the SB operations coordinating officer via telephone after the latter left for Semporna on Feb 18, 2013.

About 2pm on the same day (Feb 14, 2013), another SB operations coordinating officer ASP Wan Kamal Rizal Wan Daud also requested for information on the communication interception on Datu Agbimuddin and this time, the witness provided him with the outcome of the interception on the other number used by the target (017-8900767).

He explained that Wan Kamal Rizal made the request to enable the latter and his team to also make initial investigation on the target and carry out technical analysis.

On the afternoon of the following day (Feb 15, 2013), Muhammad Fauzairi said Anuar had instructed him to intercept calls on six more individuals — Salib Akhmad Emali, Anwar Salib Akhmad, Julham Rashid, Tani Lahaddahi, Abdul Hadi Mawan and Datu Amir Bahar Hushin Kiram.

In the dock are 27 Filipinos and three local residents who are facing one to multiple charges of being members of a terrorist group, waging war against the Yang di-Pertuan Agong, recruiting members for a terrorist group or wilfully harbouring individuals they knew to be members of a terrorist group.

They allegedly committed the offences between Feb 12 and April 10, 2013.  The hearing before Justice Stephen Chung continues tomorrow at the Sabah Prisons Department. – BERNAMA
