KUALA LUMPUR An Indonesian man was jailed for nine months by the High Court here today after he pleaded guilty to having possession of published material linked to the Al-Qaeda terrorist group.

Judge Datuk Nordin Hassan meted out the sentence to Hani Yahya, 40, and ordered him to serve the sentence from today.

Nordin said prior to the sentencing, the court also took into account the mitigation of the accused who had a newborn baby to look after but viewed the case as serious, apart from it being a matter of public interest and national security.

Hani, an oil and gas company consultant, was accused of being in possession of materials linked to the terrorist group, Al-Qaeda in the Arabian Peninsula (AQAP).

He was alleged to have committed the offence at the Casa Mutiara Condominium, Jalan Hang Isap, Bukit Bintang, here at 9 pm on September 24, last year.

He was charged under Section 130JB(1)(a) of the Penal Code which carries a jail term of up to seven years or a fine, and liable to be stripped off the rights to any of the published materials concerned, upon conviction.

According to the facts of the case, on September 24 last year, a team from the Special Branch conducted a check on the accused before raiding his house at Bukit Bintang.

From the investigations, several items, including seven mobile phones, seven sim cards and two books entitled “US ARMY SPECIAL FORCES HANDBOOK” and “US ARMY MAP READING AND LAND NAVIGATION HANDBOOK” were found belonging to the accused.

After being extracted and analysed, the items were found to contain images related to AQAP. – BERNAMA
