Jailed for breaking in

KOTA KINABALU: A foreign man was sentenced to  22 months jail by the Magistrate Court today for the charge of breaking into a premise.

Magistrate Cindy Mc Juce Balitus also ordered for the accused to pay RM2,000 fine or in default two months jail, and for him to be referred to the Immigration Department upon the completion of his punishment.

Sabri Abtani, 25, pleaded guilty for breaking into a premise at Towering, Penampang, and stole 1 unit of DVD player, hair clipper, and RM200 cash between 1.00am to 3.00am, in 28 March 2009.

He was charged under Section 457 of the Penal Code which carries a punishment of  up to five years jail or a fine.

According to the case fact, he was accused of entering the premise after breaking the roller shutter lock key and smashing the glass of the premise front sliding door.

Further police investigation also found several fingerprints belonged to the accused on the shattered glass.  In mitigation, Sabri pleaded for a lighter sentence.
