KOTA KINABALU: A man and woman were fined RM7,000 by the Sessions Court in default seven months jail for three charges of owning and selling medical supplies and cosmetics.
Jong Soo Min, 41, and Jacqueline Chang, 29, were both in possession of the unregistered items at a business premise at Kepayan Perdana Commercial Centre, Penampang, around 2.45pm in 22 April.
For the second charge committed at the same location and day, they were accused of having with them cosmetic products not labelled by the Health Ministry,.
Both Jong and Jacquelin were charged under Section 7(1)(a) and 18A(1) of the Control of Drugs and Cosmetics Regulations 1984 for both crimes, where they can be punished under Section 12(1) of the Sale of Drugs Act 1952 with a fine up to RM25,000 or three years jail minimum, or both.
They also pleaded guilty to the third charge of owning medical and cosmetic products for sale without having a valid permit under the Poisons Act 1952, of which they were punished under Section 13(a) of the same act.
In mitigation, both of them applied to Judge Azreena Aziz to minimize their fines.
Jong reasoned that their shop was recently opened and all of the items were bought from the Peninsular, with them being unaware that the products were not approved by the Health Ministry and thus unsellable.
However, the prosecution insisted for a fair punishment to be given for both of the accused. -SayangSabah
