KOTA KINABALU: A factory manager was fined with RM50,000 by the Sesions Court after he pleaded guilty to two charges of breaking regulations and limitation under the Environmental Quality Act.
For the first charge, the accused was found releasing waste with 150mg/l density, far above the 20mg/l allowed, at a factory in Keningau in 24 June last year, around 10.40am to 3.30pm.
He is also charged for releasing waste with 465mg/l density above the permitted level of 200mg/l, at the same location and time.
The man was charged under Section 16(1) of the Environmental Quality Act 1974 (Act 127) and punishable under Section 16(2) of the same act with a fine up to RM2,000, two years jail, or both, with additional RM1,000 fine per day for each crimes if it is continued after receiving notice.
In mitigation, the accused who was represented by the lawyer pleaded for a minimum punishment for both offenses.
However, the prosecution handled by the Environmental Control Senior Officer of the state Environment Department, Thamara Selvam A/L Vyapuri, applied for a just sentence to be given as an example for the public. -SayangSabah
