ACCUSED IN A FATAL ACCIDENT RELEASED BECAUSE PROSECUTING OFFICER ABSENT FROM TRIAL

PAPAR: A 30-year-old lorry driver who was charged with reckless driving that caused the death of a former Brunei national basketball player and his two family members was released by the Magistrate’s Court because the prosecution officer did not turned up for the trial today.

Magistrate Lovely Natasha Charles ordered Kasno Sani to be given a discharge not amounting to an acquittal (DNAA) following the absence of the prosecuting officer for the two-day trial beginning Sept 4.

Kasno’s counsel Nelson Angang told the court that he was willing to proceed but since the prosecution was absent, he had to apply for a DNAA but was objected by counsel Dominic Ghani, who is holding a watching brief for the deceased’s family, who then applied for another date for the prosecution.

The former Brunei national basketball player, Chin Fen Mee, 54, his wife, Chen Chin Dji and their daughter, Bernie Chin Suk Ren, 17 were killed in the accident on Nov 1, 2017 at KM 14 Jalan Papar-Beaufort in Papar.

On June this year, Kasno had claimed trial to the charge under Section 41(1) of the Road Transport Act which carries a jail term of between two and 10 years and a fine of between RM5,000 and RM20,000 on conviction.

The case was fixed for trial originally on Aug 27 but was adjourned to Sept 4 as Kasno needed to appoint a counsel to represent him.

Also present at the court was the couple’s only son, Brian Chin, 24. -SabahNewsToday
